1. Acceptance of Terms

By accessing or using ShortForge (the "Service"), a product of APHVN Limited, you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service. These Terms are governed by the laws of England and Wales.

2. Description of Service

ShortForge is an AI-powered platform that enables users to create advertising videos, including AI-generated voiceovers.

3. Account Registration and Use

You must be at least 13 years old to use this Service. By agreeing to these terms, you warrant that: (i) you are at least 13 years old; (ii) you can form a binding contract with APHVN Limited and are not barred from doing so under applicable law; and (iii) the information you provide during registration is accurate and complete. APHVN Limited is not responsible for ensuring the age of its users, though we reserve the right to verify age.

While our system may permit multiple accounts, responsible and ethical use of our service is required.

4. Data and Content

You retain ownership of the data and content you upload to ShortForge ("User Content"). You are solely responsible for the accuracy, legality, and appropriateness of your User Content. We collect personal information (name and email) and any content you upload.

5. Acceptable Use

You agree to use the Service responsibly and ethically. You will not:

• Use the Service for any illegal or unauthorized purpose.
• Engage in any conduct that is abusive, harassing, or harmful to others.
• Attempt to access data not intended for you or violate security measures.
• Disrupt or interfere with the Service's operation.
• Upload or distribute viruses or malicious software.
• Impersonate any person or entity.
• Otherwise violate these terms.

6. API Use

We offer API access. Your use of the API is subject to these terms and must be for non-malicious purposes. Any usage for data scraping, to undermine the platform, or for illegal activity is strictly forbidden. Responsible use of the API to enhance and integrate the platform is encouraged.

7. Integrations

The Service integrates with third-party services, including but not limited to Stripe, Clerk, Google Analytics, Mixpanel, Hotjar, Intercom, and Feedback Fish. Your use of these third-party services is subject to their respective terms and privacy policies.

8. Intellectual Property

APHVN Limited owns all intellectual property rights in and to the Service, including but not limited to the software, trademarks, and design.

9. Payment and Refunds

We use Stripe for payment processing. If you use purchased "tokens", refunds are not provided. Refund requests for unused tokens can be submitted to hello@aphvn.com and will be assessed on a case-by-case basis.

10. Termination

We may terminate your access to the Service if you violate these Terms.

11. Disclaimer of Warranties and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND.
